Acceptance of Terms

By purchasing, downloading, accessing, or using the New Resolve Divorce Guide, including all accompanying materials (collectively, the “Product”), you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions.

If you do not agree to these Terms, do not purchase, download, access, or use the Product.

Intended Use – Texas Uncontested Divorces Only

The Product is intended solely for use in uncontested divorce matters filed in the State of Texas.

An “uncontested divorce” means that:

  • Both spouses agree that the marriage should be dissolved; and
  • Both spouses agree on all issues, including but not limited to:
    • Property and debt division
    • Child custody, conservatorship, possession, and support (if applicable)

The Product is not intended for:

  • Contested divorces
  • High-conflict matters
  • Cases involving domestic violence or coercion
  • Complex property or business interests
  • Situations where the parties do not fully agree

Use of the Product outside of these parameters is at your own risk.

No Legal Advice; No Attorney-Client Relationship

The Product is provided for educational and informational purposes only.

  • The Product does not constitute legal advice, legal representation, or legal opinion under Texas law.
  • No attorney-client relationship is created between you and the Company, any affiliated law firm, or any attorney, employee, contractor, or representative.
  • The Product does not replace the advice or representation of a licensed Texas attorney.

Texas family law is fact-specific, and the Product may not be appropriate for your individual circumstances. You are strongly encouraged to consult with a licensed Texas attorney regarding your specific legal situation.

User Responsibility

You acknowledge and agree that you are solely responsible for all aspects of your divorce and any legal filings, including but not limited to:

  • Determining whether your divorce qualifies as uncontested under Texas law
  • Accurately completing all documents
  • Ensuring compliance with the Texas Family Code
  • Properly filing documents with the appropriate Texas court
  • Meeting all deadlines, residency requirements, and procedural rules
  • Compliance with the Texas Rules of Civil Procedure and any applicable laws or regulations

The Company makes no guarantees that:

  • Documents prepared using the Product will be accepted by any Texas court; or
  • Any specific legal outcome will result.

No Refund Policy

All sales are final.

Due to the digital nature of the Product and immediate access upon purchase, no refunds, exchanges, or cancellations will be issued for any reason, including but not limited to dissatisfaction, incorrect purchase, or changes in personal circumstances.

Chargebacks and Payment Disputes

You agree not to initiate a chargeback, payment dispute, or payment reversal with your credit card issuer or payment processor for any purchase made through the Company.

All sales are final, and access to the Product is provided immediately upon purchase.

In the event a chargeback or dispute is initiated in violation of these Terms, the Company reserves the right to:

  • Provide these Terms, proof of access, and delivery confirmation to the payment processor; and
  • Suspend or terminate access to the Product and any related services.

Intellectual Property and License Restrictions

The Product and all related content—including text, templates, worksheets, instructions, forms, and design elements—are the exclusive intellectual property of the Company and are protected under United States copyright law.

Upon purchase, you are granted a limited, non-exclusive, non-transferable, revocable license to use the Product solely for your personal divorce matter.

You may not:

  • Copy, reproduce, distribute, sell, share, sublicense, or transfer the Product or any portion of it
  • Allow access to the Product by any person other than the purchaser
  • Upload, post, or distribute the Product online or through any file-sharing service

Unauthorized use or distribution may result in civil liability and other legal remedies.

No Warranties

The Product is provided “as is” and “as available”, without warranties of any kind, express or implied, including but not limited to warranties of:

  • Accuracy or completeness
  • Merchantability
  • Fitness for a particular purpose
  • Compliance with specific court requirements

Limitation of Liability

To the maximum extent permitted by Texas law, the Company, any affiliated law firm, and their respective owners, employees, agents, and contractors shall not be liable for any damages—direct, indirect, incidental, consequential, special, or otherwise—arising from or related to your use of, or inability to use, the Product.

Indemnification

You agree to indemnify, defend, and hold harmless the Company and its affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of:

  • Your use or misuse of the Product
  • Your violation of these Terms
  • Any filings or actions taken using documents prepared with the Product

Related Agreements (Mediation Services)

If you elect to purchase or participate in non-attorney mediation services, your participation is governed by additional agreements, including:

These documents are incorporated herein by reference. You must review and separately agree to these documents before mediation services are provided.

Privacy Policy

Your use of the Product and the Company’s website is also governed by our Privacy Policy, which describes how we collect, use, and protect personal information.

By purchasing or using the Product, you acknowledge that you have reviewed and agree to the Privacy Policy.

Governing Law and Venue

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles.

Venue for any dispute arising under or related to these Terms shall lie exclusively in the courts of the State of Texas.

Modifications

The Company reserves the right to modify these Terms and Conditions at any time. Continued use of the Product after any modification constitutes acceptance of the revised Terms.
