Mediator Neutrality and Impartiality Statement

I, the undersigned mediator (“Mediator”), make the following disclosures to all participants in the Texas Uncontested Divorce Mediation Program:

  1. Neutral and Impartial Role
    I serve solely as a neutral and impartial facilitator. I do not take sides, favor either participant, or advocate for any particular outcome.
  2. No Representation
    I do not represent either participant, jointly or individually, and do not act as legal counsel, advisor, or decision-maker.
  3. No Legal Advice
    I do not provide legal advice, legal opinions, or interpretations of Texas law, including the Texas Family Code or court procedures.
  4. No Decision-Making Authority
    I have no authority to impose decisions, compel settlement, or determine the outcome of any issue.
  5. Equal Treatment
    I will treat both participants fairly and respectfully and provide each an equal opportunity to be heard.
  6. Conflicts of Interest
    I affirm that I have no known conflict of interest that would impair my neutrality. Any potential conflict that arises will be disclosed promptly.
  7. Right to Independent Counsel
    Each participant is encouraged to seek independent legal advice from a licensed Texas attorney at any time.

Individual Participant Acknowledgment

New Resolve Mediation Program

By signing below, I acknowledge and affirm the following:

  1. I am voluntarily participating in the Texas Uncontested Divorce DIY & Mediation Program.
  2. I understand the Program is intended only for uncontested divorces filed in Texas.
  3. I understand that mediation is a facilitative process and not legal representation.
  4. I understand the mediator is not an attorney, does not represent me, and does not provide legal advice.
  5. I understand that I am responsible for my own decisions, agreements, filings, and compliance with Texas law.
  6. I understand that participation does not guarantee agreement, court approval, or finalization of my divorce.
  7. I understand that all Program fees are non-refundable.
  8. I understand that Program materials are for my personal use only and may not be shared or reproduced.
  9. I confirm that I am participating voluntarily and without coercion or undue pressure.
  10. I understand that I may consult with a licensed Texas attorney at any time.
  11. I acknowledge that my participation in the Program is subject to the Terms and Conditions of Purchase and the Non-Attorney Mediation Agreement, which I have reviewed and agreed to.

Contested Divorce Conversion Disclosure and Acknowledgment

New Resolve Mediation Program

The Participant acknowledges and agrees to the following:

  1. Uncontested Requirement
    The Program is designed exclusively for uncontested divorces under Texas law. Continued participation is contingent upon both participants’ willingness to work toward agreement on all issues.
  2. Conversion to Contested Matter
    If at any time a material dispute arises that cannot be resolved through mediation, or if either participant withdraws consent to proceed uncontested, the divorce may be deemed contested.
  3. Program Termination
    Upon conversion to a contested matter, the Company and mediator may suspend or terminate mediation services.
  4. No Refunds
    No refunds, credits, or fee adjustments will be issued if the divorce becomes contested.
  5. No Continued Role
    Upon termination, the mediator and Company will have no further obligation to assist the participants.
  6. Right to Counsel
    A contested divorce may require representation by licensed Texas attorneys.
